Secret DNA Testing Can NOT Be Legal

When an alleged father refuses to cooperate in Paternity DNA testing, or the child in question is older, and you don’t want them to know that their paternity is in question, a Secret DNA test can help.  However, the secret DNA test can not be legal, i.e., the results of any such testing cannot be used in a court of law or for any formal government purposes such as child support, social security claims, immigration, etc.  The secret DNA testing is equivalent to the peace-of-mind or home DNA test where participants simply need to know for personal knowledge and do not need a document for court; they may or may not collect the samples themselves and / or had access to the collected samples; instead they simply obtain an article / item used by the person or persons they want to test.  It is exactly what the name implies . . . secret . . . expressly for the knowledge of the person requesting the test.  There are three scenarios in which the secret DNA testing may be employed:

First Scenario:  An item from the alleged father, is obtained in secret and this item is tested for DNA. A control swab is also submitted for the child.

Second Scenario:  An item used by the child is obtained in secret and this item is submitted for DNA testing. A control swab is also submitted for the father.

Third Scenario:   A secret item is submitted for both the child and the alleged father.

There are many types of articles / items which may be submitted for DNA testing and profiling, however, the lab can never guarantee whether or not the article / item submitted will have sufficient DNA to create a profile and must do an initial scan.  If you ask, most labs will do what is known as a preliminary scan of the article and inform you whether or not they found enough DNA to create a profile before moving to comparison with the control sample.  It is always better to let the lab know at the time of submitting the case whether you want to be informed about the “article / item” profile before they move on to comparing with the control sample.  If sufficient DNA is not found on the article / item submitted, then there is no need to proceed on to comparison with a control sample.  Also, you can save a few dollars by doing it this way, however, time is lost, i.e. if you need to have results back speedily then the lab will have to wait until you contact them in order to give them permission to proceed to the second stage: comparison of the two profiles.  You decide which is best for your situation, and how you wish to proceed or not proceed.

paternity-express-forensic-scientist-at-workDNA identification is quickly becoming a crime solving tool.  Law enforcement agencies have created a database of criminal offenders which they use to link criminals and suspects to unsolved crimes.  All fifty U.S. states have passed laws which requires DNA profiling of some offenders.  And law enforcement officials want to compile DNA profiles of everyone who is arrested.  At the same time, defense attorneys are using DNA profile to challenge old convictions.  With the advent of DNA testing, many, many former death row inmates and inmates charged with crimes such as rape or molestation have been freed using DNA technology.  DNA evidence speaks for itself.  DNA profiling also referred to as genetic fingerprinting evolved from a questionable forensic innovation to a powerful and widely accepted tool for identification in criminal investigations and prosecutions.  DNA profiling was used in many cases in the U.S. to exonerate former defendants who were wrongfully convicted for crimes they never committed.  DNA evidence is one of the most accurate technology of this century having the remarkable ability to exonerate innocent people while at the same time convict the guilty.  DNA analysis is also being used on plants and animals, and is being touted as the greatest advancement in forensic science to date.

Employers and insurance companies could use this technology to uncover an employee’s predisposition to disease and use the information to exclude that person from employment or insurance coverage.  The same biological sample used for DNA paternity analysis can likewise be used for other biological analysis of that person.

Because DNA is the building block from which all living things develop, variations in this sequence allow forensic DNA analysts to differentiate one person from another and one animal from another.  In 1999, a jury convicted two people of harboring a vicious animal after the couple’s pit bull mauled their 74-year-old neighbor.  Canine DNA extracted from saliva samples on the victim’s clothing matched the genetic profile of the accused couple’s dog.

Paternity Fraud Is Preventable

DNA Testing Five years after his wife left him and took their three-year-old son, John Q. Public received the shock of his life from his child’s doctor. A routine blood test showed the child could not be his biological son. A subsequent DNA test confirmed it and enlightened him to the fact that a simple paternity test after the child was born could have saved him years of needless stress and struggles with his former wife.  John finally got his divorce and he now feels that he should have some choice in how to proceed in supporting this child.  During the child’s lifetime John paid thousands in child support.  John is now unemployed and badly in debt, and he is facing contempt charges for not paying child support since becoming unemployed last year.  John’s thinking is if forensic DNA testing can exonerate convicted criminals, why shouldn’t DNA paternity testing free men like this him from responsibility in cases of court-ordered support for children they didn’t biologically father?  This story is being repeated thousands of times across the globe as men are being named as father of children they did not biologically father.  This brings to mind the old adage: “A stitch in time saves nine”.  Paternity fraud can be prevented!  It is easy to see that a simple paternity test at birth or sometime soon thereafter is much cheaper in the long run to the alternative: paying child support for at least 18 years of a child’s life for a child that you did not father.

The History of The Paternity Test

As we all know, modern science has made astounding advancements in the area of the paternity test that have made the procedure a common way to test the biological relationship between a man and a child. As you might imagine, the path to this modern version that has resulted in the technology even being able accommodate a home paternity test has taken some time.

English Law

The early paternity test and the one that we are familiar with now have shared a common path that started with an adherence to sixteenth century English Common Law that stated unless a husband could prove impotency or that he was out of the country during conception; he was generally bound by law as the father.

Modern Advancements

It’s only been during modern times that science has taken over and established a better way of establishing a legal paternity test. All these later developments have followed advancements in the study of the human genotype and the latest techniques in molecular biology. Still, the science behind the modern paternity test was really still in its infancy for most of the 1970s.

DNA Testing

With the advent of DNA testing the science behind what we think of today as the modern paternity test was brought to life. As these techniques were more developed, a wide variety of both paternity tests and paternity test laws were brought to the forefront as the science developed. Today the modern test can even include prenatal paternity testing as well as a variety of other options including grandparentage and siblingship testing.

The results that people obtain from these paternity test procedures are often used to settle questions of parentage within families. Other forms of these tests are used by Embassies and Consulates (a/k/a immigration paternity testing) in determining which family members get into a country after one petitions for them and proves a biological relationship exists by submitting to the suggested DNA testing. However, while there are many variations of the paternity test and many applications for DNA testing in general that even include forensic DNA testing, the most popular avenue for these procedures is still the simple paternity test.

Two Divisions

Generally, there are two distinct divisions of the paternity test. The at home version is considered extremely accurate but the more formal version of the paternity test is the one that can be carried out in clinics under the supervision of trained collectors and the results obtained here are generally considered a legal paternity test with results that are admissible in a court of law.

DNA Testing Exonerates the Innocent

Although many of us have been exposed to DNA testing mostly in the area of paternity testing, DNA testing is being used in many other areas.  One such area is forensic DNA testing  whereby the Innocence  Project which found that there have been 226 post-conviction DNA exonerations in United State’s history. These stories are becoming more familiar as more innocent people gain their freedom through post-conviction DNA testing.

From global problems like poverty and racial issues to criminal justice issues like eyewitness misidentification, invalid or improper forensic science, overzealous police and prosecutors and inept defense counsel continue to plague criminal justice systems worldwide.  The Innocence Project has found to date in the United States:

  • Seventeen people had been sentenced to death before DNA testing proved their innocence and led to their release.
  • The average sentence served by DNA exonerees was 12 years.
  • About 70 percent of those exonerated by DNA testing are members of minority groups.
  • In almost 40 percent of the cases reviewed, the actual perpetrator has been identified by DNA testing.
  • Exonerations have been won in 33 states and Washington, D.C.
