Permanent residents, also known as “green-card holders”, may petition (ask the USCIS for permission) to bring their unmarried children, husband, or wife into the United States, whereas citizens can petition on behalf of a spouse, a parent, children or siblings.
If for any of the scenarios above (except for a wife or husband) there is insufficient documentation of a biological relationship, the USCIS may request proof of any claimed biological relationship in the form of a DNA test to confirm that a biological relationship exists. The DNA test requested may take one of the following forms: a paternity test; a maternity test, or a siblingship test often collectively referred to as “immigration DNA testing“ .Although USCIS is requesting the testing, it does not mean that they will cover the cost of immigration DNA testing. The person making the petition (the petitioner) or the beneficiary (the person who will immigrate to the U.S.) is responsible for payment of fees for the test. Usually the embassy / consulate will provide a list of approved doctors (”panel doctors”) from which the petitioner may select or provide his/her preference from that list to the company they have selected to do their relationship testing.
A petitioner or his beneficiary can expect to pay the fees to have the DNA testing done. These fees are for the DNA test itself, their (petitioner and beneficiary) sample collection, and three-way shipping: (1) kit(s) to Embassy or Collection site in the foreign country; (2) return shipment of the samples from the foreign collection site to the laboratory in the U.S.; and (3) shipment of the report and requested documentation back to the requesting Embassy / Consulate. The procedures may be outlined as follows:

Genetic reconstruction is used to determine if a child is related to an alleged father by using two or more of the alleged father’s relatives in the comparison. A series of DNA tests are conducted in order to make this determination. It is an indirect way to determine relationship when the alleged father is unavailable to donate his own samples for testing. Results from generic reconstruction DNA testing can be used in many ways, most prominent of which is proof of Social Security benefits, inheritance claims, and other trust and estates matters.
How is this achieved?
The child’s DNA profile is compared with the family members DNA profiles. The relatives should be close blood relatives of the alleged father (e.g., brother, sister, mother or father of the alleged father). For genetic reconstruction, although every person’s DNA profile is unique, close relations will share major similarities of their DNA profiles because DNA is hereditary. Because reconstruction is complex, the mother of the child is required to participate in the testing. If she is not available to give her sample, then three or more of the alleged father’s close relatives should participate. Not all cheap paternity tests are created equal. Everyone wants to pay as little as possible for the most they can get; we all want the most we can get for our buck. However when it comes to cheap DNA testing, a paternity test that is unbelievably cheap (i.e., under a hundred dollars) may prove to be more expensive to you in the long run. The question you need to ask is: are these tests performed using the industry standard / guidelines for relationship testing? These tests are inadmissible (do not hold up) in court; because they were performed using less than acceptable industry standards; and they are usually self collected. Why is this? These tests generally unreliable because the testing may have been done outside industry standards; and they may or may not have been performed by inexperienced staff which could lead to results that are interpreted incorrectly thus leading to false results. These tests are usually self collected (you or someone you know do the collection) and no chain of custody is established. If you require a paternity test for any legal matter, additional testing would have to be done, which would involve additional fees. DNA Paternity Testing is quickly becoming the norm in everyday life. The only exception to this rule is immigration testing where the test subject provides a third party written request from a consulate / immigration / Homeland Security for specific relationship DNA testing, whereby the immigration needs th result as proof of the claimed relationship. The AABB lab is obligated to turn over directly from itself to the requesting branch immigration the results of a particular DNA test it requested. If the requested test is not turned over in the time alloted (most immigration requests gives the petitioner a set time to get the report back to them) then they immigration may proceed to make its decision without the test. Most people pay strict attention to their “deadline” date and our labs are well aware of this so turnaround time is speedy, usual two to three business days, and the report is sent directly to the requesting branch of immigration / consulate / Homeland Security. It is imperative that the client provide the “immigration letter” requesting a DNA test, as this determines the speed with which their testing is done.
